There were six constitutional amendments in Florida on Tuesday, and voters said “no” to Amendment 3. That means Florida will not become the 25th state to make recreational marijuana legal for adult use.

Although recreational marijuana won't become legal in Florida next year, low-THC cannabis products are still available at dispensaries and smoke shops across the state for people with medical marijuana cards.

Here's why Amendment 3 didn't pass despite more than 55% “yes” votes, what types of THC products are legal in Florida, and the difference between Delta-8 and Delta-9 THC.

Was Amendment 3 passed in Florida?

Although Amendment 3 received 55.9% of the yes vote, it did not reach the 60% majority threshold required for passage. In total there were 5,934,139 “yes” votes. There were 4,685,443 “no” votes.

Can I smoke weed in public in Florida?

In Florida, you can't smoke weed in public, even if you have a medical marijuana card.

What weed is currently legal in Florida? Are Delta 8 and Delta 9 products legal in Florida?

Yes, Delta-9-THC and Delta-8-THC products, which some call “diet weed,” are legal in Florida.

Although you are not legally allowed to purchase and smoke real marijuana in Florida without a medical marijuana license, you can purchase low Delta-8 and Delta-9 THC products at your local smoke shop without a medical license . The only requirement to purchase low THC products in Florida is to be at least 21 years old.

Is Delta 8 the same as regular weed?

Delta-8 products have a milder psychoactive effect than the cannabinoid that gives “real” weed its high. Marijuana and hemp are both types of cannabis sativa plants. The weed you buy from medical dispensaries comes from marijuana plants, while CBD and delta-8-THC come from hemp plants.

“Delta-8 THC is one of over 100 cannabinoids naturally produced by the cannabis plant, but is not found in significant amounts in the cannabis plant,” the FDA says on its website. “Therefore, concentrated amounts of delta-8 THC are typically produced from hemp-derived cannabidiol (CBD).”

What is the difference between Delta 8 and Delta 9?

Delta-8 and Delta-9 products are very similar in that when smoked or otherwise consumed, they produce a milder and not as long-lasting version of the psychoactive effects of marijuana.

The two main differences between Delta-8 and Delta-9 THC products are potency and regulations. Many manufacturers of Delta-8 products do not follow certain regulations, such as ensuring that the product does not contain anything that is not stated on the label. Delta-9 products are subject to stricter regulations in states where legalization has resulted in specific rules for the composition and sale of THC products. Delta-9 products are also slightly more effective than Delta-8.

Basically, even the herbal Delta-8 products are extracted and synthesized from CBD; whereas Delta 9 can be consumed in plant form without being extracted.

“Delta-9 THC can be smoked or vaporized in flower (bud) form without the need for extraction, although edibles, topicals, and other preparations require an extraction process,” according to Forbes Health.

“On the other hand, almost all delta-8-THC CBD products are synthesized, extracted and purified from cannabis.”
